Breyer To Retire
Justice Stephen Breyer, who is 83 years old, will retire this summer at the end of the Supreme Court's current term. A heated Supreme Court confirmation battle in the middle of the heated midterm elections will put both parties in a bind.
At first glance, one of the three liberals retiring wouldn't seem to make much of a difference. But Breyer occasionally surprises people by voting with his conservative colleagues. Justices Kagan and Sotomayor do not. They're ideologues. I fully expect Joe Biden will appoint another radical ideologue, moving the court somewhat to the left.
He has promised to appoint a black woman to the Supreme Court, and three names immediately come to mind: Kristen Clarke, Ketanji Brown Jackson and Kamala Harris.
If Biden nominates a far-left extremist, will Joe Manchin, Kyrsten Sinema or any Democrat senator up for reelection this year dare to resist the radical impulses of their president and party?
And what about Republican senators? Every conservative voter will demand Republicans fight any radical leftist nominated by Joe Biden.
Unfortunately, some Republican senators still cling to the fantasy that they should acquiesce to qualified presidential appointments unless the nominee has serious ethical issues. Chuck Schumer abandoned that standard years ago, arguing that judicial philosophy was the most important consideration.
The last time a liberal was appointed to the Supreme Court was in 2010 when Barack Obama nominated Elena Kagan. Five Republican senators voted for her. Three Republicans voted last year to confirm Judge Ketanji Brown Jackson to her current position on the D.C. Circuit Court of Appeals.
When Mitch McConnell got the horrible news that Justice Scalia had passed away, he announced, without consulting his Republican colleagues, that the vacancy would be filled by the winner of the 2016 presidential race, whoever that was.
The reason McConnell did that was because he knew there were Republicans in his caucus who would vote for Obama's nominee no matter how left-wing the nominee was. (By the way, Obama's "moderate nominee" was Merrick Garland, Joe Biden's current attorney general – the guy who ordered to the FBI to spy on parents at school board meetings.)
I have personally heard McConnell say that after he made his announcement regarding the Scalia seat, he got calls from Republican senators who were upset that he wasn't allowing Obama to fill the vacancy.
If every Democrat senator supports Biden's nominee and every Republican senator opposes the nominee, she will still be confirmed with the tie-breaking vote of the vice president. And her tenure on the court will be tainted as the only Supreme Court justice ever confirmed by a single, tie-breaking vote.
But I suspect that we won't get all 50 Republicans because some of them are still playing by the old rules.
A Border Worth Defending
The liberals in Washington, D.C., have finally discovered a border they're willing to defend. They're working overtime to secure it and to stop the bad guys from crossing it. But before you celebrate, there's something you need to know.
They're not worried about the same border you and I are worried about. They're not concerned about securing the border stretching from San Diego, California, to Brownsville, Texas. Washington liberals are worried about the border of Ukraine, more than 5,000 miles away from you and your family.
Nancy Pelosi is trying to ram through a big spending bill that funds border security measures in Ukraine. Meanwhile, she and other congressional Democrats are blocking every attempt to spend even one dollar to finish Trump's border wall to defend America.
Democrats insist they're trying to stop the bad Russians. But why won't they stop the bad human traffickers, gang members and drug dealers coming into our country?
They're trying to stop the Russians so Ukrainians don't get killed. I get it. But what about the record number of Americans dying from drug overdoses or gang violence?
They say we have an obligation to defend our allies. They have an obligation to defend American citizens first.
They say 100,000 Russian troops are ready to invade Ukraine. But more than 100,000 illegal aliens entered the United States last month alone.
Increasingly, the left demands that you show a vaccine ID to get into a restaurant, movie theater or a gym. But Biden is allowing illegal aliens to use – are you sitting down? – arrest warrants as IDs to get on airplanes.
Many liberal cities won't let your child go to school without a mask, but hundreds of thousands of illegal aliens are pouring across the border without masks or IDs, and most are unvaccinated.
An American citizen could leave the United States, cross the border illegally and be treated better than we are being treated now. This left-wing lunacy must stop!
A COVID Coverup?
Kudos to Fox News! Last night's edition of Special Report with Bret Baier was the kind of real journalism that has become so rare in Washington these days. To its credit, Fox News is not letting go of the COVID origins story, and Baier's presentation last night was extremely well done.
We've covered much of the same ground before in this daily report, but it's worth revisiting as the pandemic continues to cause so much economic and political damage.
In the earliest days of the pandemic, Dr. Anthony Fauci was told that his agency had in fact been funding the Wuhan lab. He sent urgent messages to Dr. Francis Collins, the former head of the National Institutes of Health, insisting on an emergency meeting.
Multiple scientists in that meeting said that a natural occurrence explanation for COVID-19 was highly unlikely and that genetic engineering in a lab more easily explained the unusual number of coincidences necessary for COVID-19 to exist. But Fauci and Collins were determined to shut down any discussion of a lab leak theory.
Collins was particularly insistent, warning that any discussion of the Wuhan lab would do "great potential harm to science and international harmony." Another scientist said that "such accusations would . . . do unnecessary harm to science in general and to science in China in particular."
What's "international harmony" got to do with anything? Communist China routinely damages international harmony.
Watch the Fox News report for yourself. It's clear that these so-called "experts" put communist China's lies ahead of the truth, ahead of America's interests, ahead of the science and ahead of your health.
Dr. Collins was considered the "consummate scientist." But he and others have the same woke mindset that Gen. Milley expressed when he called his "friend" in the Chinese military to say he would give Beijing a heads up about U.S. military actions.
These bureaucrats are globalists determined to keep the "peasants" – American patriots – under control.
Appeasing Iran
Joe Biden's foreign policy is in total shambles. His disastrous retreat from Afghanistan set the tone.
North Korea is firing missiles again.
Communist China has been bullying us and our allies from the moment Biden occupied the Oval Office.
Russian President Vladimir Putin is poised to conquer Ukraine, either politically or militarily.
And just when you think it can't get any worse . . . it does.
Three members of the U.S. negotiating team working on a new nuclear deal with Iran have quit because the Biden Administration is being too weak. Just to be clear, these are Biden's own negotiators who are resigning in protest of Biden's appeasement of Iran.
That's bad news for peace in the Middle East, and bad news our most reliable ally, Israel.
What We Are For
In his train wreck of a press conference last week, Joe Biden had the audacity to ask what conservatives were for. So, I answered his question in this daily report. We had such a positive response that I wrote an opinion piece on the same topic. It's posted online today at the Washington Examiner.
